Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you (“you,” “your,” or “homeowner”) and 1080 Ventures, LLC d/b/a Commonly (“Commonly,” “we,” “us,” or “our”) governing your access to and use of joincommonly.com and related services (collectively, the “Platform”).

1. What Commonly Does

Commonly connects homeowners with vetted, independent service providers through neighborhood group deals. We help coordinate communication, scheduling, and (in some cases) payments between you and those providers. Commonly is not a contractor, employer, or agent of any service provider. Each provider is an independent business solely responsible for the services they perform.

By joining a deal, you understand that:

  • The provider, not Commonly, performs the work and is solely responsible for quality, safety, and results.
  • Commonly does not supervise or control providers and cannot guarantee their performance.
  • Any issues, disputes, or warranty claims must be resolved directly with the provider.

2. Your Use of Commonly

You agree to use the Platform only for lawful purposes and in a way that doesn't harm others. You must provide accurate, up-to-date information when joining a deal or referring neighbors. Misusing referral links, impersonating neighbors, or submitting false data may result in suspension or removal.

3. Payments (If Applicable)

For certain deals, Commonly may facilitate payments between homeowners and providers as a limited payment collection agent for the provider. This means Commonly may collect payment from you on the provider's behalf and remit it to them after completion of work.

You authorize Commonly (or our third-party payment processor) to charge your selected payment method for the amount shown when you join a deal. Prices and discounts are set based on group participation and provider terms. If a deal minimum is not met or is canceled before work begins, any payment you made will be refunded.

Commonly is not responsible for:

  • Any damages, defects, or delays caused by providers;
  • Any additional or modified work arranged directly between you and the provider;
  • Losses resulting from incorrect or incomplete information you provide.

4. Cancellations and Refunds

Each deal may include specific cancellation terms from the provider. If a deal is canceled by the provider or by Commonly before work begins, we'll issue a refund (if applicable) to your original payment method. Once services are completed, all disputes or refund requests must be made directly to the provider.

5. Communication

By using Commonly, you consent to receive transactional emails, texts, or calls related to your deal, including confirmations, updates, scheduling details, and referrals. You can opt out of marketing messages at any time.

6. Disclaimers

THE PLATFORM AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” COMMONLY MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, ABOUT THE COMPLETENESS, ACCURACY, RELIABILITY, OR AVAILABILITY OF ANY PROVIDER OR SERVICE.

COMMONLY DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. YOU ASSUME ALL RISKS ASSOCIATED WITH HIRING AND DEALING WITH SERVICE PROVIDERS.

7. Limitation of Liability

To the fullest extent permitted by law, Commonly and its owners, affiliates, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising out of or related to your use of the Platform.

In no event will Commonly's total liability exceed the greater of (a) the amount you paid through the Platform for the affected deal, or (b) one hundred dollars ($100).

8. Indemnification

You agree to indemnify and hold harmless Commonly and its affiliates from any claims, losses, or damages (including legal fees) arising from:

  • Your use or misuse of the Platform;
  • Your interaction with a provider or other homeowner;
  • Your violation of these Terms or any applicable law.

9. Termination

Commonly may suspend or terminate your access to the Platform at any time if we believe you've violated these Terms or acted in a way that could harm others or our reputation. You may stop using the Platform at any time.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Delaware.

11. Updates to These Terms

We may update these Terms from time to time. The latest version will always be posted on this page. Continued use of the Platform after changes means you accept the revised Terms.
